Denmark Introduces National Ban on PFAS in Clothing and Footwear

In a landmark move for environmental protection and consumer safety, Denmark has announced a national ban on per- and polyfluoroalkyl substances (PFAS) in clothing, footwear, and certain consumer products with waterproofing agents. This regulation, outlined in Executive Order BEK No. 464 issued on May 2, 2025, will take effect on July 1, 2026.
What Does the Ban Cover?
- Scope: Clothing, footwear, and waterproofing agents for these products.
- Threshold: Products containing total fluorine ≥ 50 mg F/kg will be prohibited.
- Applicability: Both commercial traders and private individuals.
- Exception: If the fluorine source is confirmed as non-PFAS, the ban does not apply.
Definition of Restricted PFAS
The regulation targets substances containing at least one fully fluorinated methyl (–CF₃) or methylene (–CF₂–) carbon atom without hydrogen, chlorine, bromine, or iodine atoms attached.

Transition Period
To ease industry adaptation:
- Businesses can sell existing stock until January 1, 2027.
- After this date, full compliance is mandatory.
Enforcement & Penalties
The Danish Environmental Protection Agency (EPA) will oversee compliance.
Noncompliance may result in:
- Fines or imprisonment up to 2 years for severe cases.
- Corporate liability for violations.
Exemptions
The ban does not apply to:
- Professional safety clothing & PPE under EU Regulation 2016/425.
- Medical devices.
- Products regulated under EU REACH and POPs frameworks.
- Transit goods and recycled/reused clothing or footwear.

PFAS are known as “forever chemicals” due to their persistence in the environment and potential health risks. Denmark’s move aligns with global sustainability goals and sets a precedent for stricter chemical regulations in consumer products.
